Elian Cannot Seek Asylum

A federal appeals court ruled today that Elian Gonzalez is not entitled to seek an asylum hearing from the U.S. Immigration and Naturalization Service against the wishes of his father. The court had to decide whether a child as young as 6-year-old Elian could seek asylum over the objection of his sole surviving parent. The ruling is a victory for the boy’s father, who wants to return to Cuba with his son. But under the ruling, Elian must remain in the United States for 14 days to give his Miami relatives a chance to appeal.
